Pacific Important Policy Highlights

  • - Sick time can not be used as vacation time or PTO
  • - Sick time can not be used in excess of scheduled work hours (example: If you are scheduled to work six hours for the workday, you cannot receive more than six hours of sick pay for taking the day off).
  • - You cannot exceed your authorized hours for the week or month/quarter by taking a sick day on a day you are not scheduled to work or by making up a sick day with an additional day of work (example: if you use 5 hours of sick time with a client who has a 90-hour POS, 5 hours will be automatically deducted from the hours you have left with that client until the next month/quarter).
  • - Sick time off is not considered working time for the purpose of calculating overtime pay.
  • - No payment will be made for any balance of unused sick time off at the end of the calendar year, at termination of employment or otherwise.

Paid Sick Leave Policy (full policy)

PHS Care Providers may not use accrued sick leave in excess of their scheduled hours of work (e.g., a PHS Care Provider who is scheduled to work six hours for the workday cannot receive more than six hours of sick pay for taking the day off). PHS Care Providers cannot exceed their authorized hours for the week or month/quarter by taking a sick day on a day they are not scheduled to work or by making up a sick day with an additional day of work.

Sick time off is also not considered working time for the purpose of calculating overtime pay.

No payment will be made for any balance of unused sick time off at the end of the calendar year, at termination of employment or otherwise.

Berkeley Paid Sick Leave Policy

Any PHS Care Provider who works at least two hours a week in Berkeley (a “Berkeley Employee”) will be eligible for paid sick leave pursuant to this Berkeley Paid Sick Leave Policy. Berkeley Employees shall not be entitled to use paid sick leave until on or after 90 calendar days of employment with PHS.

For every 30 hours worked after paid sick leave begins to accrue a Berkeley Employee shall accrue one hour of paid sick leave. Such leave shall accrue only in hour-unit increments; there shall be no accrual of a fraction of an hour of such leave. There is a cap of 80 hours or ten days (whichever is greater) of accrued paid sick leave for Berkeley Employees. Accrued paid sick leave for Berkeley Employees carries over from year to year (whether calendar year or fiscal year), but is limited to the aforementioned cap.

If the need for paid sick leave is foreseeable, the Berkeley Employee shall provide reasonable advance notification to PHS. If the need for paid sick leave is unforeseeable, the Berkeley Employee shall provide notice of the need for the leave as soon as practicable to PHS.

Emeryville Paid Sick Leave Policy

Any PHS Care Provider who works at least two hours a week in Emeryville (an “Emeryville Employee”) will be eligible for paid sick leave pursuant to this Emeryville Paid Sick Leave Policy. Emeryville Employees shall not be entitled to use paid sick leave until on or after 90 calendar days of employment with PHS.

For every 30 hours worked after paid sick leave begins to accrue, an Emeryville Employee shall accrue one hour of paid sick leave. Any PHS Care Provider who works at least two hours a week in Oakland (an “Oakland Employee”) will be eligible for paid sick leave pursuant to this Oakland Paid Sick Leave Policy. Oakland Employees shall not be entitled to use paid sick leave until (1) on or after 90 calendar days of employment with PHS or (2) on or after working 30 or more days within one year from the commencement of employment with PHS, whichever is earlier.

For every 30 hours worked after paid sick leave begins to accrue, an Oakland Employee shall accrue one hour of paid sick leave. Such leave shall accrue only in hour-unit increments; there shall be no accrual of a fraction of an hour of such leave. There is a cap of 80 hours or ten days (whichever is greater) of accrued paid sick leave for Oakland Employees. Accrued paid sick leave for Oakland Employees carries over from year to year (whether calendar year or fiscal year), but is limited to the aforementioned cap.

If the need for paid sick leave is foreseeable, the Oakland Employee shall provide reasonable advance notification to PHS. If the need for paid sick leave is unforeseeable, the Oakland Employee shall provide notice of the need for the leave as soon as practicable to PHS.

Paid Sick Leave – Other Cities in PHS’s Catchment Area

This policy applies to all PHS Care Providers who work in PHS’s catchment area except as otherwise provided for in the Berkeley Paid Sick Leave Policy, Emeryville Paid Sick Leave Policy, and Oakland Paid Sick Leave policy above. A PHS Care Provider will accrue one hour of paid sick time for every 30 hours the employee works for PHS. A PHS Care Provider may begin to use paid sick time (1) after he or she has worked 30 or more days within one year from the commencement of his or her employment for PHS; and (2) on or after his or her 90th day of at-will employment with PHS.

A PHS Care Provider may use a maximum of 40 hours or five days (whichever is greater) of accrued paid sick time per year. A PHS Care Provider must use the paid sick time in increments of one hour. A PHS Care Provider’s total accrued paid sick time is capped at 80 hours or ten days, whichever is greater. A PHS Care Provider will not and cannot accrue any paid sick time of more than 80 hours or ten days (whichever is greater) at any one time. If the need for paid sick leave is foreseeable, the PHS Care Provider shall provide reasonable advance notification to PHS. If the need for paid sick leave is unforeseeable, the PHS Care Provider shall provide notice of the need for the leave as soon as practicable to PHS.
